Terms of Service

These terms explain what you can expect from VeloWhere, and what we expect from you. Please read the safety section — it matters more than the rest.

Lumenai AS ("we", "us", or "our") operates the VeloWhere application and related services ("the Service"). We are a company registered in Norway.

By downloading, accessing or using the Service you agree to these terms. If you do not agree with them, please do not use the Service.

1. What the Service does

VeloWhere gives cyclists clothing and gear recommendations based on the weather forecast along a specific route. You can import routes from connected services such as Strava, Garmin Connect, Wahoo and Ride with GPS, or upload GPX, FIT and TCX files directly.

The app is free to download. Some features may require a paid subscription — see section 4.

We develop the Service continuously. Features may be added, changed or removed over time.

2. Eligibility and your account

You must be at least 16 years old to use the Service, or have the consent of a parent or guardian.

If you create an account, you are responsible for the information you give us being accurate, for keeping your login credentials secure, and for activity that happens under your account. Tell us at post@lumenai.no if you believe your account has been used without your permission.

Accounts are personal. Please do not share one account between several people.

3. Connected third-party services

You can connect VeloWhere to third-party services such as Strava, Garmin Connect, Wahoo and Ride with GPS. Those services are operated by other companies under their own terms and privacy policies, and your use of them is a matter between you and them.

We access your data on those services only with the permissions you grant, and you can disconnect at any time from within the app or from the provider's own settings.

Those providers can change or withdraw access to their APIs at any time. If that happens, the related VeloWhere feature may stop working, and this is outside our control.

Weather data is supplied by third-party forecast providers. See section 6.

4. Subscriptions, billing and price

4.1 Plans

VeloWhere is free to download and includes route import, weather analysis along your route, and gear recommendations. Some features carry a fair-use limit — for example a weekly allowance of route forecasts — shown in the app.

A paid subscription ("VeloWhere Pro") unlocks additional features. Plans and prices are shown in the app before you buy, in your local currency, with any applicable tax shown before you confirm.

4.2 Who charges you depends on where you subscribe

This determines who takes your payment, who issues your receipt, and who handles refunds and cancellation.

4.3 Paddle is our merchant of record for web purchases

VeloWhere Pro is currently sold only through the App Store and Google Play. Web purchase is not offered today. The following applies if and when we offer purchases on this website:

Our order process for purchases made on this website is conducted by our online reseller Paddle.com Market Ltd. Paddle.com is the merchant of record for all such orders. Paddle provides all customer service enquiries relating to billing and handles returns.

This means Paddle — not Lumenai AS — is the seller for web purchases, issues your invoice, and collects and remits any applicable VAT or sales tax. Paddle's terms of use and privacy policy apply to that transaction alongside these terms.

4.4 Automatic renewal

Subscriptions renew automatically at the end of each billing period unless you cancel. You will be charged for the next period shortly before the current one ends.

You can cancel at any time through the channel you subscribed in (see the table above). For App Store purchases, cancel at least 24 hours before the period ends, or the renewal will already have been taken.

Cancelling stops future charges. It does not by itself refund the period you have already paid for, and you keep access until that period ends. Refunds are covered in our refund policy.

4.5 Free trials and introductory offers

We may give new accounts a time-limited free trial of VeloWhere Pro. Our trial requires no payment details and converts into nothing: when it ends, your account simply returns to the free plan. You will not be charged unless you actively choose to subscribe.

If we ever offer a store-backed introductory price or payment-backed trial, its length and terms will be stated at the point of purchase, and the standard renewal terms above apply to it.

4.6 Prices and price changes

Prices are shown inclusive of VAT or sales tax where that applies to you. The exact amount and currency are confirmed before you complete a purchase.

We may change the price of a plan for new subscribers at any time. If we change the price of a plan you are already on, we will tell you in advance and you will have the chance to cancel before it takes effect. Where the App Store or Google Play requires your explicit consent to a price increase, your subscription will not renew at the higher price without it.

Some plans are offered as a fixed price for as long as the subscription remains continuously active. Where that applies, it is stated at the point of purchase. Letting such a subscription lapse means the plan may no longer be available to re-join.

5. Safety — please read this one

VeloWhere gives suggestions, not instructions. Weather forecasts are predictions and are sometimes wrong. Gear recommendations are generated automatically and cannot account for your individual physiology, health, experience or equipment. Route data may be incomplete, out of date, or show roads and paths that are closed, private or unsafe to ride.

You remain responsible for your own safety. Always use your own judgement about conditions before and during a ride, obey traffic laws, and dress for the weather you actually encounter rather than the weather that was forecast.

Do not operate the app in a way that distracts you while riding. Set up your ride before you leave.

The Service is not a safety device, a navigation aid for emergency use, or a substitute for official weather warnings. Check official sources when severe weather is possible.

6. Acceptable use

Please do not:

  • • use the Service to break the law, or to harm others
  • • copy, resell, sublicense or redistribute the Service or its content
  • • reverse engineer, decompile or attempt to extract our source code, except where the law expressly permits it
  • • scrape, bulk-download or systematically harvest data from the Service, or access it through automated means we have not authorised
  • • interfere with the Service, probe it for vulnerabilities without our written permission, or place unreasonable load on our infrastructure
  • • upload content you do not have the right to upload, or that infringes someone else's rights

If you believe you have found a security vulnerability, please report it to post@lumenai.no rather than exploiting it. We will not pursue good-faith security research reported to us responsibly.

7. Content and intellectual property

The Service, including its software, design, text, graphics and the VeloWhere name and logo, belongs to Lumenai AS or its licensors and is protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial cycling use.

Your content stays yours. Routes, activities, files and preferences you provide remain yours. You grant us the licence we need to store and process them in order to operate the Service for you — nothing wider than that. How we handle your data is set out in our privacy policy.

Map, elevation and weather data are supplied by third parties and remain subject to their own licences and attribution requirements.

8. Availability and changes

We work to keep the Service available and accurate, but we do not guarantee uninterrupted or error-free operation. We may need to suspend it temporarily for maintenance, upgrades, or reasons outside our control.

We may add, change or discontinue features. If we discontinue a feature that is a significant part of a paid plan you are on, we will give you reasonable notice and, where appropriate, a pro-rata refund for the unused part of your subscription.

9. Suspension and termination

You can stop using the Service at any time and cancel your subscription (in your App Store or Google Play account settings). You can delete your account yourself at any time: in the app under Settings → Delete Account, or on the web at velowhere.com/delete-account.

Deleting your account does not cancel your subscription. Subscriptions bought through the App Store or Google Play are held by Apple or Google and can only be cancelled in your account settings there. Please cancel first, then delete.

We may suspend or terminate your access if you materially breach these terms, if we are required to by law, or if your use puts the Service or other users at risk. Where it is reasonable to do so, we will warn you first and give you a chance to put things right.

10. Disclaimers and liability

To the extent permitted by law, the Service is provided "as is" and we do not warrant that forecasts, gear recommendations, route data or elevation data are accurate, complete or fit for any particular purpose.

To the extent permitted by law, our total liability to you for any claim connected with the Service is limited to the amount you paid us for it in the twelve months before the claim arose.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer, your mandatory rights under Norwegian and EEA consumer law are not affected by anything in these terms.

11. Changes to these terms

We may update these terms as the Service develops or the law changes. The date at the top of this page always shows the current version. If a change materially affects your rights or a plan you pay for, we will give you reasonable notice in the app or by email before it takes effect, and you may cancel if you do not accept it.

12. Governing law and disputes

These terms are governed by Norwegian law, and disputes fall to the Norwegian courts.

If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live, and you may bring proceedings there.

Please contact us first at post@lumenai.no — most things are settled quickly that way. Consumers in Norway can also bring a complaint to Forbrukerrådet (the Norwegian Consumer Council), and consumers elsewhere in the EEA can use their national consumer dispute body.
